I have been doing some research to determine if it is possible that my poker playing in australia is taxable. I came across the above two private rulings made in regards to poker players with fundamentally the same set of facts (online player, not employed uses tracking software etc..) however the outcome was the opposite. In the first case the ATO ruled that the player had to pay tax whilst in the second the player did not. Can anyone elaborate on the possible reasons for these seemingly contradictory rulings?

Both those rulings look like one's I facilitated as a tax agent. Ignore the second one, it was full of flaws and withdrawn on appeal.

Sorry Allin, to clarify,

The successful ruling was the correct one, the negative response from the ATO was appealed and withdrawn.

Their argument had so many holes I was able to drive a truck through them.
