I'm new to this forum and I've read the stories about the two cases where "superusers" could see opponent's hole cards to fleece them out of millions of dollars. The resolution to the UB scandal was that UB was to pay back all the money that the superusers won plus interest to the respective losing players by November 3rd, as far as I understand. It is also to my understanding that UB was negligent in catching the cheat when many red flags should have been raised (screenname changes, huge cash outs, etc.). Now my question is, can a civil suit be made against whoever the cheat/cheats is/are (e.g. Scott Tom, Russ Hamilton if guilty)? Also, can UB/AP be sued for not providing the protection it promised to provide to its consumers? I know in cases of fraud and fleecing people out of money, treble damages can be sought, where the plaintiff can be awarded up to three times the amount they were originally screwed out of. Would this be one of those cases? Can a class action suit be made on behalf of all players of UB? I love the game of poker and get increasingly angry when I read that prosecution against these bastards might not happen because of the shades of gray that exist on the legality of online gaming in the US. And if prosecution is not possible against them, I would like to at least like to see their assets frozen, the same way OJ was found not guilty in criminal court, but was found liable in civil court. Anyone with infomation that can help me with these questions, I would love to see it. Thank you in advance if you do have answers for me.

Yes. It is clearly possible.

There are a couple of preliminary issues first, before moving past that answer.

1. How much would you pay counsel to file this action on your behalf ?

2. Would you like a referral to a firm in Chicago which takes on contingency work against online gaming companies' assets ?

I'm not not sure if the questions you pose are rhetorical or are directed at me. I have no interest in getting involved myself, just curious as to what can be done. It would seem that by the amount of money that was stolen, it would be worth it to the affected parties. The problem is, poker players are more likely to not be litigious because its kind of a buyer beware type situation. They can rationalize not suing because they figure they could have lost regardless. Also, I am less concerned with suing the company as I with suing the actual entity/person that implemented the cheating. It would be easier to prove a preponderance of evidence exists that the cheater had malicious intent to defraud than it would to prove that the company was negligible. If nothing can be done to the cheater in a criminal court, I would like him to not be able to make another dime in his life without it going into someone else's pocket.
