affiliate germany

hey

anyone from germany.

i would like to know if its posible to regristre a poker affiliate buisness from germany? pay tax and make it legal.

or do i have to move to malta to do that ?

i know its much less tax % in malta , but im fine with the german if its posibel

the reason im asking is that i live in germany but are not german

I think best is to use an affiliate software provider, use their deals and let them handle all the legal issues.

I am not from Germany or familiar with their laws but i guess all profits can be taxed. Simply when signing your tax declaration or whatever it is called there you note out "other profits" or something like that and pay tax on that. Weekly, Monthly or Yearly.

If you already have had a bunch of existing action then this also means you would have to backtrack all of your profits and pay on those also.

This is not concrete info of course, as mentioned above, i'm not from Germany or familiar with their laws. I am only using common sense and knowledge of some other countries taxation systems which do not have "gambling affiliation tax" written into the tax law.

Paying taxes and running a business in germany are two different things. From the tax law perspective, it doesn´t make a difference, if the business you run is legal or not. So technically a drug dealer has to pay taxes as well.

Basicly you have to check, if being an affiliate is legal in germany, and then set up you business. I am not sure, but I think it might be from legal oder a grey zone, because techncally you are some sort of agent.

If you don´t live in germany, I would rather run your affiliate business in your own country. Because if you don´t live in germany, you don´t have to pay taxes there neither. But if you run a business there, your business is getting taxed there.

I don't think you would have to move to Malta, but you might have to do the licensing through there.

Lets say it this way:

"What is best for me? - A computer having windows xp 32 bit using 3 gb of ram or one having windows 7 64 bit using 6 gb of ram??"

Comparing Germany with Malta is asking in a way the question above.

As you might know there's a german saying: "Äpfel mit Birnen vergleichen!"

Remember the german "Glücksspielstaatsvertrag" (last revision) was made to prevent germans still from taking part in online poker (and casino) betting, so what do you think would a german bureaucrat say when telling him you like to run an online poker affiliate business??

Starting business within the maltese offshore zone there won't be asked any questions about, read my lips.

(I always wonder how one could really imagine starting any kind of (online) business from inside of germany especially being non-german even though living there.)

if one decides to start a business in the maltese offshore zone..can we still pay taxes in germany?

syrsly question ? you wanna pay 2 times taxes ?

needed to edit: Malta is not a offshore zone ... only a place where the taxes are moderate... but definetly not like seychelles, vanuatu , cayman island ect.


and to the german law; first of all noone is paying taxes on this , but this may be a stupid advice.

The right dvice is to call your townhall ( gemeinde , rathuas ) and say you want to marketing online poker !! most times this is allowed as you dont own a room and only promote them in any way. From there you take the papaer um sich selbststaendig anzumelden and than you are free to pay taxes to the german governemtn who will spend it than for Greece or for inventing white and yellow carrots ( yeah, no joke.. Germany spend yearly over 100k to invent a white carrot )
