Didn't supreme Court rule no mandated breathalyzer a while back? Need a warrant for blood I think.

If you are flinching around, a needle can do serious harm to you or the nurse too. Maybe this is the method to choose and just complain about the constitutionality of the state forcing a needle into your body against your will for a non-violent offense.

circumstances like a hit and run or some type of danger.

I'm not sure if you're referring to the same thing or not. You could refuse a breathalyzer, but then you have to submit to a blood draw. If you refuse the blood draw after refusing the breathalyzer, then they just take it from you with a forced blood draw.

It does seem that there's been more Supreme Court action on forced blood draw, even though there's still implied consent in place with your driver's license/vehicle code, depending on the agency they might be required to obtain an expedited warrant to be able to gather their evidence from you before your bac level dissipates. I wonder how hard that warrant is to obtain

Tiger Woods says no alcohol involved and it was a "mix-up" of medication. Why not just take a breathalyzer then unless the concern it would be 0.00? What medication "mix-up" happens at 3:00am in the morning?

Supreme Court ruled on DUI checkpoints if I recall, you don't have to submit to their questions. I assume Tiger was probably just pulled over.

I was in jury duty once where a guy had a dui but we voted him innocent.

1. It depends if you need a boating license in the place you are operating the vessel. In many places you don't need one.

2. To drive in other countries, you typically need a license of some kind. If you don't have one, you can't drive. But if he has an extra copy of his Florida license, it wouldn't be an issue.

Also, on the "should I refuse the breathalyzer" question, here is an opinion from an attorney.

"The majority of states have some type of "implied consent" law, which means refusing a breathalyzer test usually does more harm than good.
"(An implied consent law) means that when you sign up for your driver's license, you also consent to taking a breathalyzer test upon demand from a police officer," says Eric Misterovich, a DUI attorney at Newburg Law in St. Joseph, Michigan.
Many times people refuse a breathalyzer because they don't want to provide evidence of their blood alcohol to police out of fear of being arrested. However, the penalty for refusing the breath test can be harsher than the OWI (operating while intoxicated) charge, says Misterovich.
"In short, at least for first-time offenders where there is no car accident or bodily injury, refusing to take a breathalyzer will likely subject you to greater penalties than the OWI" in Michigan, says Misterovich."

That wording is pretty terrible. Refusing an actual breathalyzer test means you are already arrested. Refusing a field breathalyzer test is standard and should always be done.
