i was wrong about 'any and all appeals go to CAS'

Quote:
CAS, as its name indicates, is a form of arbitration, and a hallmark of that is that parties require to agree to enter into it. In some cases contracts lay down that any disputes MUST be settled by arbitration. Here it is possible that Rangers could have asked the SFA if they could agree to take the case to CAS, but the SFA might well have refused on the basis that the JPP gave no right of appeal after the AT decision. In any event, Rangers did not ask to go to CAS, nor were they, in my opinion, obliged to do so.

No Fifa or SFA action for Rangers going to court.

bleh, that is only one very minor hurdle.

also no deals on the table for rangers, they'll have to take their medicine this time.

--

Husker, if Green has to form a new club, do you think it is right for rangers even to apply for a spot in the top league or should they start at the bottom and work their way up?

--

Motherwell have a %26 increase of season tickets sales v this time last year.

I suppose any club in that position would apply. It's up to the other clubs to decide whether it's right or not.

you have no personal opinion on whether it is right or not?

how about starting at the bottom and earning their way to the top? pump some much needed money into all of Scottish football on the way back and show some contrition, this way they will be accepted much easier than if they just get parachuted straight into the SPL.

lastly, Celtic fans are quite happy for Green to be the man for rangers, he seems as bad as Whyte with his moonbeam statements but is just looking to milk **** right out of rangers/fans.

--

one final question...you really see an escape out of all this for Rangers?

I'm not really all that bothered either way whether they stay in the SPL or go to the 3rd division.

some good news....

HMRC have appointed their preferred liquidators in the event of the CVA failing (won't be long then) and puts to bed Charlie Moonbeam's £5.5m guaranteed asset purchase.

Green is well on his way to becoming a fan favourite...

Quote:
The former Sheffield United chief executive claimed that there were no issues surrounding the raising of funds for the Sevco bid, while he also stated that it was working towards raising a total of £30m it had pledged to put into the club.

He added: "I’m from Yorkshire, I will never, ever, have enough money. I’ve never been to a church where there wasn’t a collection and this is now my church and if anyone comes here, they have to pay.

"Either pay as a fan to watch the game or pay as an investor to be part of the shareholder register. So I’m always going to have money and if I told Ally McCoist tomorrow we’ve got £50m but I could raise £100m, he’d tell me to go and raise £100m so he could go and buy Ronaldo." He also admitted some investors in the consortium would "prefer one option or another" when it comes to the newco or CVA routes out of administration.

Above all I'm glad we will stop having to listen to this story soon enough,it feels like that lot have been in administration for years now.

The CVA proposal never really stood a chance so I'm sure Green and the administrators have been preparing for liquidation for a while now.

Point out if Im wrong at any stage here.

- Rangers FC go bust but they then form a new club
- SPL clubs vote on whether or not to allow this new club to start in the SPL
- The current Rangers playing staff would be part of this new club
- Ibrox would be their stadium

Yes?

- SPL clubs vote on whether or not to allow this new club to start in the SPL - and SPL clubs are becoming more pissed off by the minute at their behaviour, so a free pass is highly unlikely.
- The current Rangers playing staff would be part of this new club - not unless the player wants to move and has to be on the exact same terms as before (they cannot afford this).
- Ibrox would be their stadium - hahahahhahahah no they will own **** all, Green's moonbeam cheap asset sale will be shot down in an instant by HMRC/BDO.

Yes?
anything else?

what i've read over the last few weeks suggests that there'll be no rangers in any league set-up next season (5's don't count).

Marty is apparently wrong on the Ibrox part, since Green's deal is binding (per the BBC). So he gets Ibrox and Murray park for £5.5 mil and Duff and Phelps take at least £5 million of that for their pay.

BDO's role is to investigate the liquidation of the club, as in 'how did it come to this' which is obviously going to take months. And provide a huge amount of the lols.

Green certainly knows how to come across like a dick though, he was talking earlier this week about how he had decided to increase next seasons transfer budget by £1.5 million and blah blah blah. That must have gone down well with Hearts while they get screwed on their transfer cash. And the trying to sign Gattuso. It's like he's actively trying to make the club look as unsympathetic as he possibly can.

Green's deal is not binding with the liquidators, it is binding with Duff and Fud tho, pity they are out the picture now.

seriously DS, ask yourself why would the main creditors allow a cheap asset sale (£3m less than CVA) that gets them even less than is offered in the CVA.

spot on with your last comments, they didn't want the CVA to succeed.

Because if they were found liable in the 'big tax case' the CVA then turns out to be worth nothing at all, as compared to the 9p in the pound it was apparently worth.

Block quote from the BBC 'Rangers in crisis' thread http://www.bbc.co.uk/sport/0/football/18410999 :

And an anonymous texter asks: "So who sells the club's assets? Surely if HMRC want raise capital through their sale of assets it shouldn't go to the first bidder?"

That's a key question, Mr Anon. HMRC have appointed insolvency experts BDO to investigate the club's liquidation. But it is Duff & Phelps who have entered into what they say is a binding agreement with Charles Green and it is they who will work with Green's consortium to create the "newco". That latter bit can be done in a few days, we hear.

BDO's role is to find out how the business got to be in such a sorry state. Their investigation could take months. I imagine Duff & Phelps will be clearing their desks once the transfer of the club to Charles Green goes through.

However, what my colleague Chris McLaughlin is currently trying to establish is whether another party - the Blue Knights or another consortium, for example - could gazump Green's consortium by offering the administrators and the creditors more than the £5.5m promised by Green for the club's assets.

As things stand, and what Duff & Phelps and Charles Green are telling BBC Scotland, Green's deal is binding: he will get Ibrox Stadium, Murray Park and other assets for £5.5m.

not getting you here.

CVA = £0 for almost all creditors
Liquidation = small money for the charge holder (one Mr Whyte or ticketbus) = £0 for almost all other creditors.

you may be right and they try go ahead with the sale, doubtful it goes thru without HMRC challenging it in court. not sure of the correct phrase but i think it is 'gratuitous alienation' that will scupper this if they proceed.
