HUGE shakeup to the court coming. We could see a solid liberal majority for the first time since when...the Nixon years? (paging ElliotR for some history).

If Scalia has actually passed away, the Senate must refuse to confirm any justices in 2016 and leave the nomination to the next president.
Well that didn't take long
02-13-2016 , 06:09 PM
Debate tonight will be ****ing epic
02-13-2016 , 06:10 PM
Wow
02-13-2016 , 06:10 PM
Its gonna take till mid to late November to get a replacement, right? Longer if Trump somehow wins.

Congress about to find new heights of most liberal ever.
02-13-2016 , 06:11 PM
Just saw this on cnn. Wow
02-13-2016 , 06:11 PM
Can Obama appoint himself?
02-13-2016 , 06:12 PM
Is this the first Obama supreme court pick that would change the ideological balance on the court? LOL in a presidential year, with the senate as partisan as it is and a GOP majority?

One of hte arguments Hillary should be making is that electibility is super important because it's better to have a slightly less liberal president that has a much greater chance of getting elected so that things like this aren't left to the crazy Repubs.

Presumably he could but according to that episode of the West Wing where John Goodman became president he'd have to resign as president

Toobin saying it will be a fight to even have it set for confirmation. **** that. Obama has almost a whole 4th quarter left. One year. Constitutionalists or what? President appoints u confirm or not, not abstain.
02-13-2016 , 06:15 PM
Republican butthurt going to be through the roof all year, probably refuse to confirm anyone until after election, both parties' turnout increases to record levels
02-13-2016 , 06:15 PM
What's the procedure for nominating a Supreme Court judge? What happens judges vote 4-4?
02-13-2016 , 06:17 PM
Hillary for Supreme Court!
02-13-2016 , 06:17 PM
It looks like only 2 Supreme Court nominees have ever been filibustered.

Republicans are going to have to change their plans.

Quote:
Top Senate Republicans are considering gutting the filibuster for Supreme Court nominees — a move that could yield big rewards for whichever party controls the White House and Senate after 2016.

The move, still in its early stages, reflects growing GOP confidence in its electoral prospects next year. But it could also have a major immediate impact if a justice such as 81-year-old Ruth Bader Ginsburg steps down, making it far easier for President Barack Obama to get a replacement confirmed.

This is really interesting for the presidential election as well. Republicans have to be careful, if they block a reasonable and qualified nominee they will be perceived as stalling to delay it to 2017 which I'm sure would anger democrats and turn out voters like crazy. But it also might turn out Republicans, so who knows they might go for it.
02-13-2016 , 06:18 PM
What a bombshell!
02-13-2016 , 06:19 PM
could have easily been RGB btw

she should step down now for maximum lolz

edit- i don't actually really know the ins and outs of how that works
02-13-2016 , 06:20 PM
I think you need a majority vote in supreme court decisions to rule for the plantiff. If there's a tie the defendant wins by default.
02-13-2016 , 06:21 PM
Good riddance
