So haven't had a drink in two months because of work and such, drinking now, newcastle. Litigating a contract-type case vs a $10bn corp. They have a team of Harvard lawyers from a good firm and I was kinda ill in the fall (lost 60 lbs since sept., doing much better) and we ended up losing on summary judgment because the judge (and my older very trial experienced co-counsel) didn't understand a technical issue. Anyway, so then they filed a motion for 200k in fees vs our community college student client. We offered a low settlement to end the case and not appeal. They said they wanted to proceed with their fees motion, which I opposed and we'll likely win. So, we filed notice of appeal, and they again didn't agree to a renewed low settlement offer. However, they seem not to understand how an adverse decision from the appeals court could screw them over in many ways. They just wanted to show us who was boss. So, having pissed me off, I worked to draft a great appeal brief (won best brief in my appellate advocacy class at top 10 law school). Anyway, spent 150+ hrs researching and writing what is probably my best (45 page) brief in 10 years of practice. I think we are 66%+ chance to win the appeal, as a new case came down last month that helps us a fair bit and I point out what led to the district court's misunderstanding of the law, etc.

So, today I get a call from opposing counsel saying they'd accept the prior settlement we offered because their client wants to rein in the litigation budget a bit and didn't want to spend the "$30k" (the way their firm works I think they will bill out $75k+ opposing our appeal). Anyway, having spoken with the client a few days earlier, I was like, well we're really not interested in settling on the terms discussed before we had done all the work on the appeal, but it you raised the offer to $X, we could maybe settle. Anyway, I think he's come to appreciate the reasons I gave him previously for why it was in their best interest to settle, particularly an appellate decision overturning the district court's SJ grant could have broadly negative implications for them, much more so than if they had lost their SJ motion in the district court. So, basically, I'd say that he's done a terrible job, particularly at $700/hr, protecting his client's interests in the case. And that makes me glad.

I'm looking forward to winning the appeal, restarting the district court case, and preparing for trial, and him coming back wanting to settle for the increased amount we offered today. This is kinda a rant, but I see the road ahead on this case, and while it's not our ideal, it's much better for us them for them. So, screw you opposing counsel guy for enriching your firm at the expense of you client. Best case their client will be out another $250k in legal fees. Worst case they'll be out a lot more because they wanted to show us who's boss. I think Gladwell wrote somthing about this sorta thing recently.

whiskey flowed tonight.

went to a steakhouse at an indian casino for dinner

they tried to convince us that their steaks were THE BEST because they are dry aged with HIMALAYAN SALT. it's PINK SALT. I said "that is the biggest load of bull**** I've heard today" and the whole table went crazy, given the amount of bull**** they had heard from various vendors today. the waitress was a little embarassed but I madeup for it on her tip.

desert: gigantic pile of gelato rolled in pulverized heathbar crumbs, flambe'd in bacardi 151. not bad. I asked how many sherpas died to bring us these himalayan heath bars, the waitress was not amused.

I don't know for sure, but I'm pretty sure alcohol and marriage works on a pretty bell curve. I just don't know what side of the hump I'm on.

Ok, I had the wrong kind of Indian casino in my head. You really need to start specifying non-native-american-indian-casino.

Sooooo I went on a date tonight... It actually went prett well, suprise suprise.

I keep meeting girls that seem interested but have boyfriends or are married and that shut just feels weird as ****. Like I'm not looking for that but whatever...

I've only been living in this new town for a month... I like it so far,, no beef with where I'm living. Just wish I had more friends and people to hang out with but I feel like I've been doing a good job of just getting myself out there,,, jointed a kickball league and church and what not.

Started watching "This is the End" last night while trying to go to sleep, and finished watching it before I went to sleep. I'm not a movie reviewer, and I couldn't even tell you what was good about it, but I'd give it four stars.

Needing to lose weight has cramped my drinking style, but thanks to a long bike ride and surprisingly low calorie dinner today, I'm currently 1700 calories under budget. I have some ideas about how to fill that up.

I have 36 hours to develop an entire website for my business from scratch. I haven't written a single line of HTML in almost 10 years. I also have a full day of work tomorrow. This is an excellent time to start drinking!

I'm about 5 beer deep aorn, and I have 12 hours till deadline. I've pretty vlearly defined my doctype, I definitely know what CSS stands for, and most of my graphics are almost completely organized, more or less. I can do this!
