Driver of car in Ohio is told not to speak while officer searches car, so he doesn't immediately notify officer of CCW, officer gets very angry, says he should have "taken two steps back, pulled my glock 40, and put 10 bullets in your ass and let you drop"

I saw this a few days back, and obv the cop's language are reprehensible (and he's no longer a cop afaik), but it does seem the dude played this incredibly stupidly. I mean the cop was searching his backseat (illegally I suspect), and the guy can't even go like 'hey buddy have a concealed weapon.'

Re: Law and Order 2

An interesting thing to think about re: the prison rape thing is, with more than 2 million Americans in jail, it is likely that tens of thousands of people are in jail unjustly (assuming an accuracy rate of 99% for convictions, honestly have no idea if this is too high or too low). If these innocent people are representative (which they probably arent, but whatever) then it is reasonable to assume that THOUSANDS of innocent people are victims of sexual assault in prisons. And thats just those who are actually, literally innocent, not those who perhaps are "guilty" of drug-related crimes that many would consider immoral to outlaw, or whatever.

Perhaps a sobering rebuttal to those who say "they all deserve it, **** 'em" although probably not, since the obvious follow-up is "gotta crack a few eggs." Surely it is worth violently raping a few hundred or thousand innocent people in order to rid our country of the scourge of drugs, right? I mean, can't argue with the results.

edit: quick googling suggests that perhaps 2% false conviction is conservative, although the source of that is about as robust and incontrovertible as my musings above, so maybe close to 50,000 innocent people in prison in US. Thats something like 3500 sexual assaults.

Re: Law and Order 2

While my own personal anecdotal evidence in a Canadian jail probably won't shed much light on the situation in American prisons, during a 45 day stretch which was dropped own to 30 days for good behaviour I witnessed two acts of violence. The first, on my first day, was a fellow inmate smashing a fellow inmates head against a wall (followed by a remark from the assailant, 'this is how we do'). The rumour was that the guy who got smashed was a 'package thief'.

The second incident was a guard attacking a prisoner. We would intermittently have our cells searched, and while they were being searched we would stand naked near the shower rooms. While the inmate was standing there naked a guard came up to him yelling "dont you eye **** me *******" and then smashed the prisoner. Ironically, this incident happened while I was in 'protective custody' where you were supposed to be safer.

The third incident was an attack on me. I had lost a game of chinese poker which meant I owed my desert to a fellow inmate. Prior to the lunch where I was going to pay him, I also broke a dominoe of another inmate, a very tough looking African American gentleman who told me to repay him I could either give him all my meals until I was released (1-3 days) or I could let him hit me once near the shoulder. The guy, who I was on fairly friendly terms with since we played cards all the time, he seemed fine despite the fact that the state wanted to lock him away for 20+ years labelled as a dangerous offender, which he no doubt was), was like pure muscle. So I choose to offend the fatty who I was gambling with and he tried to make a move on me but I just out ran him and yelled for guards so I didn't end up getting hurt.

I'm not a law enforcement officer, but I'm wondering what my reaction might have been after pulling the bunch over due to suspicions they were up to illegal activity, then when I start looking for illegal stuff in the backseat of their car with my focus on the backseat, the cracks between the seat cushions, my head is down.... and the driver says "I have a consealed gun on me officer". One thing I think should be pretty obvious is that if it was that severely emotionally disturbed cop with serious anger issues there is a good chance he could have perceived it as a threat rather than 'notifying him of lawful possession' and dove out of the car while reaching for his gun and blasting away.....

It also seems to me the proper protocol should have been, at a minimum, for one officer to stand by the drivers door guarding/monitoring him while the other officer searched. And I'm guessing the better protocol would have been to have all the individuals out of the car prior to any search. This seems like common sense to me and I have no training in how to be police. I have general training in how to deal with dangerous/ex-cons and severely mentally ill people and their approach seems unsafe to me. If it is the good approach I'd like for someone with police training to explain to me why because common sense dictates to me it's not. Sure, this might be considered monday morning quarterbacking on my part but hell, they are police officers who are supposed to have training for these sorts of situations so that it becomes standard and second nature for their and the suspects safety.

Can you immagine if the guy in the front seat turned his head and said "I have a gun on me" rather than saying it more officially?

Re: Law and Order 2

^ A little more of an update on this and some lolawyer-speak.

Quote:
The fatal police beating of a mentally ill, homeless man, prosecutors say, began with one officer snapping on a pair of latex gloves and a single threat.

Kelly Thomas was sitting on a curb in Southern California as police checked his backpack when Officer Manuel Ramos donned the gloves and made two fists in front of him. Prosecutors say Ramos then said: "Now see my fists? They are getting ready to F you up."

"This declaration was a turning point — a defining moment," Orange County District Attorney Tony Rackauckas said, as he announced Wednesday that Ramos and another officer have been charged in Thomas' death.
Quote:
"We simply cannot accept that in our community that it is within the police's right to place gloves on a police officer's hand and put his fists in front of a detainee and say, these fists are ready to 'eff' you up," Rackauckas said. "That is not protecting and serving."

In response to claims about Ramos, the gloves and the threat, his attorney, John Barnett, said his client was using the "lowest type of force." He said Thomas resisted arrest by kicking and swinging at officers.

"It was an attempt by the officer to use words not force to get the suspect to do what he's supposed to do," he said. "He sought to avoid physical confrontation with words. There was no compliance by Mr. Thomas."
Quote:
"He made two fists with his gloves on, two fists. He lifted his fists in front of Kelly Thomas so he could see them," the lead prosecutor said. "... That's when it went from a fairly routine investigation, a fairly routine police detention, to an impending beating by an angry police officer."

Thomas replied, "Start punching, dude."

Ramos then grabbed Thomas by the arm and pulled out his baton when Thomas pulled away. He swung his baton and chased Thomas, who ran behind a police car, eventually punching him in his ribs and tackling him before holding down his neck and lying on top of Thomas to pin him down, Rackauckus said.

The coroner concluded that the cause of death was mechanical compression of the thorax, which made it impossible for Thomas to breathe normally and deprived his brain of oxygen, Rackauckas said. Other injuries to the face and head contributed to his death, he said.

Cicinelli, who arrived later, kneed Thomas twice in the head and used a Taser four times on him as he screamed and yelled in pain, Rackauckas said. Cicinelli hit Thomas in the face eight times with the Taser, he said.

"His numerous pleas of 'I'm sorry,' 'I can't breathe,' 'Help Dad' (were) all to no avail. Screams, loud screams, didn't help," the prosecutor said.
