A nit, but some free blacks did have the right to vote in some states and territories prior to 1870. For instance, it
wasn't until 1838 that they
lost this right in Pennsylvania. Also, my assumption is that even prior to black male suffrage other racial and ethnic categories were still quite relevant in drawing up political districts.
