folding here from a game theory point of view is terrible however if you know the guy is a nit and only going to show up with the same hand or better then i suppose you could argue folding.

His range is not capped. People check/call flop and check-raise turn with sets all the time. I don't think people semi-bluff often enough in this spot @ PLO5. If his range is K9+ with some semi-bluffs mixed in (which I think is a fair estimate) then you can go ahead and make a fold here with dry K9.

Keep in mind that this is exploitable, do be selective with who you fold this against.
