Legally i agree, I've just found that if you are not drunk and think you have a decent chance to pass a sobriety test or be close, just being somewhat honest about how much you had, especially if you can do it very coherently the cop often will decide not to waste his time.. Essentially by taking this line I'm implying to the officer that i think I can pass a sobriety test, and by being direct about it i may get to avoid it all together, and cops get lied to so much sometimes just telling them something more truthful earns better treatment. If you go the coy "i have rights" route, you may in fact win any future case but it will send the cop into dick mode and he can still ruin your night and be a pain in the ass and bring you in.

Both times i was pulled over i basically went this route and one time the cop just ran my registration and let me go, the other time he did a quick eye test - follow his pen thing and then let me go. Maybe i'm just running good... Also i'm a pretty big guy(6'3 225) and white and on the clean cut side of things, so this may have helped.

How about instead of saying "I have rights" or w/e you are imagining, you just don't say anything about drinking?

Also, it looks like one out of the two times you got pulled over and said you have been drinking, the cop performed the most difficult sobriety test that exists. Let's imagine you had drank slightly more that night; if you failed that test, do you think the cop would have just let you go? Obviously not, and you went ahead and handed them an easy conviction with your "be honest with the cops" routine.

Congratulations on driving sober, but I suggest you don't take this line when you are actually driving drunk.

What do you say when the officer interrupts you and asks "Have you been drinking tonight, i smell alcohol?" If you lie and say no, he's going to be as dick as possible to you and has the authority to give you a breathalyzer test which will confirm that you had been drinking.

Again, how is it a lockup conviction? I'm not admitting to being drunk, I'm admitting to drinking within what would be considered legal limits for a adult male, 3 or 4 drinks over as many hours. According to the bac calculator on the first page 4 beers over 3 hours is 0.021%, so I'm basically admitting to being well within the legal limit.

You don't answer. You are not required to answer any question other than what your name is.

You can get a DUI even if you test below the levels if the officer views you as drunk.

If he thinks you might blow over, he's going to make you blow. Being nice or honest won't get you out of it.

The cops are trained to ask you uncomfortable questions and make you feel like you either have to answer "yes I was drinking" or lie by saying "no." What you want to do is redirect their questions back to the reason they pulled you over, which can be admittedly tricky, but if you give a solid "non-answer" answer, you should be able to placate them without an admission of guilt. Strike the line between combative and confessional and you're money!

When they ask you to breathe into the meter, that's fine - they SAW you consume spirits, but only after you were no longer in control of a vehicle

2nd DISCLAIMER: If your BAC actually shows you drank the spirits in the glove box on the way to work that morning, no cute tricks or fancy lawyer will save u

Just refuse to blow into the breathalyzer. I was recently pulled over after drinking half a bottle of Jack Daniels. I refused to blow into the breathalyzer so they gave me the walking test and counting test. After passing those I was free to go. Ended up being a $200 fine for not blowing into the breathalyzer.

^^ I grew up in Louisiana, where this is the pro play.

You get a minor suspension and a small fine for refusing.

Not all states are like this. I'm in NM now, and when you get your license here you sign a form pre-consenting to any breathalyzer analysis. If you get pulled over and refuse to blow, they automatically charge you with 'aggravated DWI', which is normally reserved for people who blow more than twice the legal limit, and it's a mandatory 6 months in jail.
