You can't just buy a debt that's being paid $5/week under an existing agreement and claim it's all due instantly.

Hasn't Babs missed any number of $5 payments? I'm sure there's no full formal contract involved, but payment plans generally only remain valid as long as the person is actually paying as agreed, and it seems that the creditor would usually be within his rights to accelerate to "full amount due immediately" once the debtor has breached.

I don't find commercial lending provisions to have any relevance to this HIV babs debt. There's no formal contract so once it's agreed to be $5/week, if he falls behind paying $10-$15 and catching up seems way more reasonable than accelerating the entire amount due.

Point is, you can't just buy a (very shady) debt and dictate your terms or use language not agreed upon.

It's enough money that you could get yourself into trouble. Obviously there shouldn't be a major concern, but anything that could be construed as a financial crime for greater than $1k is usually a good thing to avoid.

Interesting debate! If I recall correctly, while I joked about pulling a Gramma on Nima that wasn’t my stated intention of buying the debt. My intention was to buy the debt, charge services fees to the account for having to service it, then have a kid that works for me use he same tactics on Nima that he had used in his collections job.

So he would still be on $5/week + $45/week service charge for every week I had to service he debt account.

Now assuming that I was doing this like a Gramma would and not like XYZ collections/recovery services I don’t really see any problem with being unscrupulous when recovering a debt that in itself is shady AF.

If that attempt to buy that debt makes me shady, you’re full of **** - attempting to do anything with Drane and Nima that’s more than $50 is the shady party for sure
