I bought a brand new tractor 2 weeks ago and after 20 hrs of use all of the transmission fluid dumped out on the ground in a big puddle. I called the dealership I bought it from and they will repair it under warranty but only if I pay to have it trucked to them (or deliver it myself which isn't an option). Having it trucked to them will cost close to $1500.00.

I spoke with the manager and then ultimately the owner and they've refused to offer any assistance unless I pay in advance to have it trucked to them. Am I out of line to be mad? Is it unreasonable to expect them to come get it and have it repaired?

The discussion with the owner went downhill quickly when I used the word "god" in our conversation. The owner told me not to take the lord's name in vain and that he expected an apology from me. There was no apology but less than 5 minutes later he told me "You could be struck down by lightning for taking the lord's name in vain." The conversation ended shortly after that.

Can you do something legally?

I would check that and threaten them with spreading the word about the mess with tractor around his potential clients. I don't think that there a lot of tractor buyers, so if you can divert even a few from buying from him, he would have bigger loss than 1500$

I wouldn't apologize, but would refrain from any further mentioning of god, christianity or so......

Although..... Now that I think about it, that could be also a possible strat if you know bible well: you could bully him with citations from bible, threaten with hell or so and force him in this way to repair the tractor.

Captain, what brand of tractor is this? You might find some traction if you go straight to the manufacturer, they certainly don't want their reputation hurt by a ****ty dealership.

It's important to note that it won't cost the dealer $1500 or anywhere near that to come pick it up. The dealership's truck makes regular tractor deliveries and pickups in my area on a weekly basis. It'd cost them whatever the time and cost would be to divert their truck 30 miles and the time it takes to load the tractor. They want me to pay them full freight price. They'd make a very nice profit if I paid them to come get it.

I cited the golden rule which is what led to the lightning warning.

It's a Massey. I called the manufacturer and they're going to have one of their area reps get back to me.

Both the manager and the owner tried the following line which I found amusing:

"If you bought a new car and it broke down on the side of the road would you expect the dealership to come and get it for free?"

Me "Yes"

"Well, only if you have some kind of special insurance. The dealership won't just come get it for free."

Me "Yes they will, and they'll give you a loaner to use."

May be good idea is to start with samuri8's idea. If it won't work to check out what real options you have to reach potential clients of this dealership. I mean may be you know some people personally as neighbors, may be there is a forum or so, may be you can leave somewhere evaluation. Then not do it immediately, but contact the dealership and threaten them with it. Remain nice and friendly when they get pissed. Ensure that if they do something you get renewed warranty.

And in every case you need to check-out what are the legal options. What exactly is written in the warranty? What is usual custom with such problems? I mean it is big enough money to go for it legally, but you have to be sure that you win.

I met the guy who authored the Lemon Law, and you bet your ass the dealership is coming to get it for free, and providing you a free rental until its fixed.

These dudes obviously sound like stubborn morons.

Most new cars comes with free Roadside Assistance, essentially AAA. Yes, towing. My car was in for warranty work last month (at 59k miles, mind you) and the dealer set me up with an Enterprise rental for 9 days completely free, and even dropped me off at the rental place.

This is what I was hoping for and expecting before I called them. Every implement dealership I've ever dealt with has a mobile truck that goes around making onsite repairs, but not these guys.

Yea, I meant in the context of the car dealership example bozo used.

I wouldn't be surprised if it extends to tractors, or other motor vehicles.

I would think a god-fearing man selling agricultural equipment to people who work the land would have it in his character to fix a tractor that breaks immediately.


Maybe you need to try a more direct communication approach. Perhaps you visited at your church on Sunday and spoke ill of this tractor dealership, perhaps your priest was interested in it and other members of the local religious community are starting to think poorly of this man.

Before you followed up I was already thinking that these dip****s have a god-damned delivery truck on site that makes deliveries daily. Not sure why they are taking a hard line.
After spamming their emails with gay porn, I would consider a face-to-face as you seem like a pretty ornery dude in general.

Then drop El D's Jules monologue on him if that goes bad. That would be perfect.
