This is not a juicy story like the chess set fiasco but anyway.

My father was the trustee of my grandfather's trust with my aunt named as alternate trustee. The trust docs state that if either the trustee or the alternate trustee predeceases my grandfather, their half of the trust goes to their kids, me and my siblings or cousins.

My father predeceased my grandfather which made my aunt trustee. My grandfather recently died and to move the matter through probate I have been sent docs to sign. These docs include the original trust agreement and a will dated after my father died which modifies the beneficiaries to only my aunt and her children if she predeceased my grandfather.

I am sorta OK with this as obviously my grandfather can give his estate away to anyone he wants but another part of me thinks that since the original agreement was to give 50% of the estate to each of his kids (my father and aunt) or if they predeceased him, their 50% share to their children that my aunt is really not being true to my fathers agreement as to how the trust would be handled. If my father really wanted his sister to get his 50% of the estate, this would have been expressed in the trust while he was alive and it wasn't, he wanted his share to go to his 3 kids.

While I can't be sure what would have happened if the shoe was on the other foot and my aunt predeceased my grandfather, I don't think that my father would have modified the documents to allow 100% of the estate to go to him rather than the original split as intended.

But she didn't predecease your grandfather, right? And how would she be a beneficiary if she did?

But you said it was a will, dated after your dad died, but before your grandfather died, right? So your aunt didn't make that will, your grandfather did, right?

Unless your grandfather is not in his right mind and you want to try and prove that in court, he can change his will whenever he wants.

There's a woman at my work who is CONVINCED it is a law that if a grandfather wants to skip over his daughter and leave her inheritance to her children, that this is illegal. I'm pretty sure if people can leave money to their pets before their children, that you can skip over a generation.

I am not furious over this just a little wtf. like I wrote before, I understand it was his right to leave his estate as he saw fit.

Did your Aunt care for him a lot when he was dying? Also, you're pretty much grown up, right? Are her kids younger?
