There is a man awaiting trial for sexually abusing children and video taping the abuse. he has decided to exercise his sixth amendment right and defend himself.

he is of course allowed to review all the evidence in this case including the video tapes he has made with the victims.

should we always be allowed (even in circumstances like this) to exercise our amendment rights?

should there be a case when we say no?

He's innocent until proven guilty. We shouldn't start stripping people of rights merely because they're accused of a crime. If he's competent to stand trial, there's no way around this. They're not letting him look at this stuff unsupervised, so that's a good measure being taken, but that's as much as can reasonably be done.

i think videos of him sexually abusing children are enough evidence to prove him guilty.

whole justice system is a waste of money. you could see the videos and throw this guy in jail within hours yet it somehow takes months. there needs to be a large injection of common sense

Sure. In most cases where there's enough to charge someone, he's probably guilty, and almost certainly in this case. However, even really ironclad things like damning video evidence, confessions, etc., are not enough if the police and prosecution don't do their jobs properly.

While I completely agree that the system is needlessly slow, people should still get due process if we're going to incarcerate them.

It is what it is; it's a flawed system, but a flawless system doesn't exist.

Article says courts have ruled specifically w/ regard to the lawyers being able to review child porn, he's his lawyer, and that's that. I'm more upset that the state prosecutes after he's already convicted in Federal court which is a huge waste of money, detective agrees.

The answer is so clearly yes that no one should need to ask the question. The whole point of the constitution and the various amendments is that the rights apply to everyone and are entrenched in law.

The expression "hard cases make bad law" should have been linked as the first reply and the thread locked, buried under a tonne of concrete then nuked from orbit.

i agree with you completely i have just noticed a lot of people dont, that is why i opened it for disucussion. so for some perhaps it is not as easy a question as you might suspect.

Those people are reacting emotionally and are the types who only respect the Constitution when it's immediately convenient to them. There really is little more to it.
