I was put on 2 years supervised probation about 2-3 months ago. I've only seen my po 3 times but she is really nice and cool and seems to like me fine. Maybe a couple weeks into the probation I got drunk and had a ride home and while I was in my room getting ready for bed my parents called the police since I was drunk. The cops came and made me do a sobriety test. I did like half of it and was really mad at my parents so I kept saying things to them like 'is this what you wanted?'. Then this female cop yelled at me for disrespecting my parents and put me in cuffs right then and there. They took me to the jail to sober up and once I was sober they released me at like 5am. I never got a charge or bail or anything. I called my PO and told her everything and she really didn't mind and just told me you can't drink while on probation. I haven't since. I later enrolled in school and I'm a full time student with all A's and in the honor program. I've never done better in life than I am now. Recently my bf saw online that I have a court date for this Monday (it's fri night) for public intoxication and public swearing. First off, neither one was in public. I was at home getting ready for bed! Second, I wasn't swearing and I don't cuss in front of my parents. They'd kill me if I did. So I'm going to fight these charges but still, even though my PO didn't violate me, can/would the judge see that I was intoxicated and had contact with the police and spent the night in jail while being on probation... Can/would the judge violate me himself in court on Monday? I'm so scared I could be violated by the judge and arrested/detained. I'm doing so well now and school and everything is amazing and I'm happy and finally doing well. I don't want to ruin everything by going back to jail. Any help or advice will help. Thanks everyone.

I've never wanted to say "first" so badly in my life. It seems to me like alcohol might be a negative influence in your life, and your version of events might not actually be what happened. Just a sense I get.

i'm confused. are you saying you weren't charged, but you have a court date, and you only found out about it because WVU saw it online?

Best thing is to write about it all in public, attached to a name associated with you. Have you considered asking Facebook about it? Bigger audience there I would think.

In my experience, there is a very good chance that you will be violated in court by the judge. Sorry.

Basically. I mean they brought me to jail, put me in a cell to sleep it off then released me at like 5am. I didn't have bail or even talk to a magistrate and I didn't get any papers or anything. WVU saw it online and that's how I found out I have these 2 charges and the court date

cops dont just let you go and forget to tell you that youve have been charged. Sometimes you dont need a bail hearing you just have a promise to appear.

I grew up in VA and, unfortunately, they are the biggest sticklers for the law of the states Ive lived with.

They didn't violate me. Plus this happened a couple months ago and I've seen my po a few times since. Would have been told and probably arrested if they had violated me. I'm trying to see if the judge would violate me.

Look Ami, Michelle or whatever your name is. Just go to court and tell the judge exactly what you did and don't blame anyone else for anything. If you can manage to not blame anyone else for anything then the judge will have some sympathy and will go easy on you. The judge is human too. If, however, you can't stop yourself from throwing blame on others in front of the judge, he will become upset and he will not go easy on you. Got it? Tell the truth. No blaming. Can you do it?
