i "read" your "post" that "stated" that SEC will start going after businesses and companies.

the SEC press release, however, explicitly states that they are not pressing charges against anyone and this is a word of caution for investors:

Quote:
In light of the facts and circumstances, the agency has decided not to bring charges in this instance, or make findings of violations in the Report, but rather to caution the industry and market participants: the federal securities laws apply to those who offer and sell securities in the United States, regardless whether the issuing entity is a traditional company or a decentralized autonomous organization, regardless whether those securities are purchased using U.S. dollars or virtual currencies, and regardless whether they are distributed in certificated form or through distributed ledger technology.
which means you are wrong.

"Going forward, according to the SEC, companies that are issuing tokens as part of an ICO (if they are considered securities) need to register with the commission. This will force companies to comply with regulations that ask them to reveal their financial position and the identities of their management. The SEC also concluded that online exchanges where tokens are bought and traded may have to register as security exchanges."

This is a shot across the bow, the SEC will certainly get involved in ICOs in the near future.

Long term, I believe this position by the SEC legitimizes the industry and brings in a lot more institutional money. Short term it could have catastrophic implications for ETH. Also, this was inevitable. You don't create financial markets worth billions with forecasts into the trillions and not have governments step in to regulate. I'd be shocked if other agencies like the IRS don't also publish position statements clarifying how trading of cryptocurrency creates taxable events at every transfer regardless of whether any fiat was exchanged or not.

Is this not actually published already?

There's this: https://www.irs.gov/uac/newsroom/irs...rency-guidance

I know folks who have argued that inter-currency exchanges of crypto to crypto wouldn't be taxable by claiming you can't determine gain/loss. Also, the IRS hasn't required (that I'm aware of) that exchanges track and report exchanges for US citizens.

What is your deal lol?

Why do you continue to lump me in with others whose opinions I don't share? I've posted few times in this thread, and my earliest posts were to encourage others to take some time to understand what they are investing in and the tax implications of their transactions. I found all the bros bragging about getting in at 150 when it hit 400 to be laughable and cringe-worthy.

Doesn't post for 6.5 days while on vacation --> "abandoned thread." Ok then.

Have informed you several times I've been long on btc for a long time. Was right in there with you taking lumps 2013-2015. I did not simply roll my btc into eth in 2015 like some others might have. I put new fiat in and it is by far the best investment I've ever made. Even if what I'm still hodling right now went to $0, it still would be. Made one large ETH sell after Bancor token sale.

As for the actual news -- obviously it's horrible and at MINIMUM will be some short-term pain. The scenario where exchanges get rekt and/or de-list will be much worse.

But... totally not unexpected that the SEC would rule that at least some tokens are securities, and that they'd use the Howey test in most cases.

Interesting and glad I haven't sold any personally.

Would recommend everyone read his tweetstorm starting with this tweet:

He specifically says that ether is probably NOT a security, even though it was sold in an ICO. Again not surprising -- some ICOs sell securities, some do not.

Certainly this makes the Coinlist sale of Filecoin very interesting (at least, relative to other token sales), assuming they still go through with it. For those not aware, it is only open to accredited investors, and contrary to other investments, this is not a simple self-certification. You actually have to provide proof to make the investment.

I think it's obvious ICOs / exchanges need some regulatory oversight. I hope long-term this leads to the best outcome which strikes some sort of balance between innovation and regulation.

On waves platform I can create a dividend paying security in about 2 seconds. How will the SEC stop it?

Note: I made a SEC security that pays IRS dividends. I put up a sell wall on the dex if anyone is interested.

I am pretty sure you can do that with ethereum too.

Any idea why ETH is being left behind while BTC rebounds? Usually the kind of move together.

Polo having even more problems than usual. Deposited ~60 ETC there 2 days ago which cleared on chain fine but wasn't in my account. Then received an email shortly after 200 confirmations:

Quote:
We’re very sorry to inform you that we are currently experiencing a momentary delay on deposits of this currency.

We are actively working to identify and resolve the problem as soon as possible.

Thank you for your patience and we’re sorry for the inconvenience, don’t hesitate to reply to this message if you have any question.

Sincerely,

Poloniex Support Team
Not sure if that is a leading indicator to further problems, but its not some crazy low liquid alt. There also is still no way banner on their ETC page I can find denoting a deposit delay for whatever manufactured reason they would give.

Bittrex in same window worked much smoother with eth/etc and I've been very happy with their service so far.

Prob more related to polo being incompetent than a red flag considering SEC ruling or something outside, but not good and definitely avoid imo while other options are available.

There's a large amount of ETH owned by ICO's who are selling.

Almost everything is down except BTC. I'm guessing most people are moving from Alts, ETH, etc to BTC to get BCC when it forks on Aug 1st.

Yeah, this is what people want to believe, but if we're observing actual bcc trading volume right now, its not happening.

my only question is whether the Kazuya & Two Shae family ICO office invested in it.

But in all seriousness this is just complete amateur hour. Embarrassing all around.

I personally would never send eth to an address with all those zero's at the end. That looks so off.

I doubt its an inside job. The money is in a black hole.
