There is a laundry list of reasons why Epic Poker League owes this guy $20K (in fact the equity of the seat was over $24K with the added money and the small field).

If you don't want him in your Main Event, fine, but you simply cannot take his prize away after he's already won it, because you don't like something he's done in the past.

EPL is taking advantage of the fact that this guy is embarressed/ashamed of his past and that Divita will go away quietly rather than making a big stink about the fact that EPL has no business letting him register and play in the Pro/Am and then taking the value of his prize away.

The reports I have read are that he wasn't DQ'd but that he 'withdrew'. They must have known that they couldn't legally DQ him after the fact, just because he had a criminal record. Don't Matusow and a few others have criminal records as well.

I personally can't imagine that he voluntarily said to Annie et al, 'Yes, you guys are right, I don't meet the standards of your League and should have never considered entering the Pro/Am in the first place. Don't know what I was thinking. I'm happy to forfeit my prize of a $20K seat and we'll pretend I never signed up.' There had to be some coercion. The Annie Duke/Admo AUFA fiasco springs to mind.

The right thing to do was to say, here's 20K, the value of the seat you won fair and square, however many of our league members are not comfortable with you playing in our ME, please don't register. Anything other than that is just wrong IMO.

That is certainly a good point in differentiating the situations. However what is the cause of action here though? Larceny for taking property that belongs to him? It seems like casinos usually win. I have been trying to research gaming laws and casino rights for a few minutes but I am not finding anything. Most of the causes of action I can think of require state action (deprivation of property).

Seems like a very clear case of theft to me, if it happened as was reported. Good job by Annie Duke to look worse than a sex offender (not that there isn't a lot of idiotic hysteria involved with "sex offenders").

Save yourself the time. If it was found that somebody cheated to win money then there is a legal basis for them having to give it back. However, if the person won fair and square it doesn't matter what their criminal record is.

It's tilting to see some people compare young men hooking up with teens as being on the same level as an old man touching a child. It's no big deal and will continue to happen.

If they did background checks on all the players, it would probably cut the field in half. Here comes a new wave of scams to jump a payout.

This is outright theft IMO, I don't care what he did outside the game, they took his fee and let him play, therefore they should pay the guy.

If they want to 'punish' him in some way, not that it's their job to dispense vigilante justice, they should just announce 'x was a sex offender, we are screening in the future for sex offenders as sex offenders can't play in OUR poker games'.

MJ pretty much nailed this - EPL is reverse freerolling and had zero right to deny him his prize after he'd already won it based on previous actions for which he was already convicted and punished.

Obviously the sex offender label is provokes a lot of emotions but calling each other child molesters for offering the opinion that a 22 and a 17 year old isn't that unusual is crossing the line.

Age of consent varies from state to state and country to country, which makes criminalizing sexual behavior between individuals who would be considered consenting adults one state over a real conundrum problem, IMO - I believe there should be a federal age of consent, but that seems unlikely to happen. But any system that sometimes punishes 16 year olds from having sex with a 14 year old is pretty messed up, IMO. Not that I necessarily think either of them are emotionally prepared for sex, but charging one of them with a felony and forcing a sex offender label on them for life is ridiculous, IMO.

I'm not familiar with the specifics of the case in the OP, but since other players with felony records aren't immediately disqualified this seems like a pretty problematic and hypocritical decision to me.

EPL is the biggest fail ever and they are so lucky BF happened so people need poker fixes.

I think to do this they need to have stated that no sex offenders are allowed before the tourney took place. It is just wrong no matter what this guy did to then take his 20k seat away after he won.

Also important here I think to make a distinction between true pedophiles who are sexually attracted to completely sexually immature children, and those who are merely attracted to adolescents (who actually do display some sexual maturity and fertility). Many people wrongly lump these two together when in reality they are completely different situations.

In placing Chino Rheem on probation, the EPL Standards and Conduct committee stated the following:

During the formation of the Epic Poker League, the Standards & Conduct Committee made a policy decision that any personal conduct that occurred prior to the League’s formation would not affect initial eligibility of a league member.

Suspending DiVita (and he was told he would be suspended if he didn't withdraw) seems completely inconsistent with that "policy decision".

This thread should be exclusively about whether or not Mike Divita deserves the 20K value of the EPL main event seat or whether EPL was in their right to only return his origianl $1500 satellite buy-in

All posts on what 23 year olds should be able to do to 17 yo's is completely off-topic. Hopefully an NVG mod can delete all of those posts but leave this relatively important thread up for the main discussion.
