The Feds knew this story would major news and would not have humiliated themselves without a strong case.

Kind of like that huge case a year or two ago that involved the Trinchers, Boosted J, Abe Mosseri, etc. Multi-million dollar Russian Mafia racketeering ring. Dozens and Dozens of people charged, tons of press, etc.

What happens?

Most ended up getting nothing, a few guys got probation, and the alleged "ringleaders" got like 18 months in country club jail.

I'm not sure I agree with this. The US government has a long history of going after sectors of society that people in power at that time deem unseemly or detrimental with little or no proof or solidity to their case.

I'm not commenting on the validity of this particular case, just saying that the government has shown time and time again that, even in "high profile" cases, they're not always standing on solid ground.

My assumption is that the prosecutor will allege that they had sbo bet open as a way to get market prices to use as a base for the prices offered to their Asian customers.

ANATOLY GOLUBCHIK was sentenced yesterday in Manhattan federal court to five years in prison, and VADIM TRINCHER was also sentenced today to five years in prison for participating in a racketeering conspiracy in connection with their roles as members of a Russian-American organized crime enterprise. GOLUBCHIK and TRINCHER were also each ordered to forfeit more than $20 million in cash, investments, and real property.

These cases are really free-rolls for the Feds, if they fall apart they can always claim the dirty criminals lawyers mislead the judge/jury/grand jury.

It's not their money that gets wasted bringing weak cases, and it's their political careers that get boosted by high profile convictions. So their only real cost is opportunity cost, a failed case just pushes off their run for Mayor/Governor/Senator/Representative another election cycle, or their partnership in a top firm a couple years.

Prosecutors know they most likely will get a huge fine paid out by Phua in a plea bargain.

Fruit from the poisonous tree theory regarding bail. The bail funds posted have to satisfy the court that the funds were not illegally obtained. That is why there are sworn affidavit's by those who posted the monies, to show where they came from.

If the Gov believes the suspects bankroll were obtained illegally, the courts will not allow those funds for surety.
