Which is true, if you look at the FBI and DOJ stance on online poker, so he is correct, please read more carefully, this was brought up and clarified once in this thread already

I stand corrected so thanks for pointing out that semantical clarification.
You are correct that many in the government do indeed CONSIDER it illegal.....but that little qualifier about "even though playing isn't illegal at all" is sorely missing and it does end up misleading the uninformed reader.
Many reading the article would make the fair assumption that "government considering it illegal" means the same thing as it actually being illegal for me to play from home.
Using a line like that, which may be technically correct, without clarifying that there actually is NOTHING illegal about playing online, is pretty deceptive and misleading writing and is in dire need of being corrected.
What Joe Shmoe is doing when he plays for pennies from home is NOT illegal and I don't even think the DOJ thinks that it is (based on the language in the UIGEA).
It's illegal to operate a site from the U.S. and it's illegal for a bank to knowingly facilitate such transfers but it's NOT illegal to play.
Because of the way that line can be misinterpreted I think it should either be clarified somewhat or eliminated entirely from the article. Just too gosh-darned misleading.
