Banning man charged in sexual-assault case By Jason Pesick on December 23, 2008 5:52 PM | Permalink | Comments (1) | ShareThis A Banning man has been charged with committing a lewd act on a child in connection with an incident involving a 14-year-old boy, authorities said. Banning police and regional sexual assault officers went to the home of 50-year-old registered sex offender Michael John Divita this morning, said Banning police Detective Robert Fisher. When officers arrived at the home at 356 N. 21st St., Divita fled, and officers decided it was too dangerous to start a pursuit.

Is this the charge that was dismissed? Ok, got you.
These are precisely the things that happen when people choose to take the law into their own hands. Who knows if this complaint was legitimate. Don't you wonder why the boy chose not to testify? The boy need not even testify to get a conviction, which indicates to me that there was likely no case against the man in the first place, hence a 2 year wild goose chase. This is why people are presumed innocent until proven guilty. According to you, it's the other way around. God bless America, I guess.
