The police don't have to prove it, the District Attorney does.
Anyway, circumstantial evidence can be completely sufficient to prove your case beyond a reasonable doubt, despite endless TV shows and movies that don't seem to realize this fact.
Plus I imagine they'll collect some forensic evidence without too much trouble.
Plus he'll probably say a few thousand stupid things anyway if he doesn't confess outright, and will end up taking a plea bargain.
