Picking hairs, I know, but it's actually trademark infringement that they are suing me for. Got served the lawsuit about 5 minutes before the start of the MiniFTOPS Stud H/L event. Guess I have even more motivation, now, to win it so I can go hire an attorney.

Mason, if you're reading this I'm sorry that I registered the domain name. It wasn't my intention to aggravate you. But there is no way in hell I'm paying $15k for you to drop this case.

Here is the comment I sent to the LV Sun's reporter about the lawsuit.

I'm the poker player getting sued by Mason Malmuth. If you are interested in getting a comment, you can email me any question you might have or even better hit me up on skype or call my cell at (# deleted). If you just want a general comment, here is what I've got :

"It is never fun to be sued... especially by someone you look up to and respect professionally.

Mason Malmuth is a genius poker theorist and poker author and his books are largely responsible for much of my own success in poker, including my world series of poker bracelet.

Personally, however, Mason has shown over and over that he is a bully and willing to outspend his perceived adversaries into submission.

The lawsuit he is bringing against me is based on a domain name that he currently owns: twoplustwopoker.com. It is without merit and is designed to encourage me to pay him off or face a substantial legal bill defending myself against it.

Unfortunately, the strategy will work, and he will be successful in wasting both of our time and money as well as the Nevada taxpayer's money. The only people who will be coming out ahead in this game is Mr. Malmuth's overpriced attorneys."

I assume the first guy was involved with the various accounts that were created mocking PokerStars and 2+2 that got banned repeatedly?

gonna need to show evidence of confusion, and a bunch of other crap.

I doubt 2+2 will win unless that site was getting major traffic.

IE: i can sit on the street w/ a sign that reads 2+2 poker, and have a briefcase full of poker chips by my side. if no one approaches me, no harm has been done, and thus there is no civil case.

You're an active enough domianer to know that you would lose this in a UDRP 100% of the time (which is what they should've done- just UDRP'd your ass, taken the domain away from you, then seek damages in court with that acting as a strategic backbone).

This is the sort of bull**** squatting and TM infringement that gives all speculative domain owners a rotten name. I've stood up for you on other stuff where I felt you got a raw deal, but I hope they rip your face off on this one.

Assuming Dutch created the site to either splash it with ads or have it redirect to a site supported by ads, he stands to lose whatever amount 2+2 can prove its visitors are worth/day with damages for a percentage of what the 2+2 brand is valued at.

There are thousands of cases that have successfuly rocked domain squatting ad farmers, it's not as if 2+2 will have any problem showing mandatory precedent.

If Dutch, who is a moron, had more than 100 visitors route through his dummy page, then he should settle quickly and quietly because the legal fees from both sides (after he loses) will tear into him further if he's dumb enough to fight this. It's one thing for some random dude to create microsoft_copypage.com, than it is to have a poker player who is very well aware of the brand create TwoPlusTwoPoker.com... How stupid could you really be?
