NY will certainly allow online poker at some point, it's just very difficult getting anything passed in NY as it is the most corrupt state - it's not like New Yorkers have some sort of moral objection that will prevent it from happening. By the same token, if they passed a Federal bill with an opt-out, NY would never opt out because they'd never be able to pass anything.
As far as the guy talking about powerball, that's a totally separate issue. NY already had lotto and was making plenty of money on it before powerball came along. You might be able to argue that it would be a while before NY joined some sort of state collective of poker sites, but once they see the green they will certainly authorize it for intra-state play.
