There are exceptions in the UIGEA for legal intrastate gaming. Sometime in late 2011, the DOJ released an opinion letter that the wire act only applies to sporting events and contests (AFAIK, this was the only act that suggested online gambling was illegal at the federal level). I believe this was taken as a green light for states to go ahead and legalize online poker without worrying about violating federal law. Since online poker is legal in those states, it is excluded from the UIGEA.
I think this is the basic gist of it, someone please correct me if I'm wrong.
