Is this real? Am I the only one with not resolved complaints? What is your experience/knowledge with the Isle of Man Gambling Supervision Commission?

Core Principle: To ensure that games are fair

Typical elements of complaints: - Bet Disputes - Games Rules / Terms & Conditions - Software/Hardware Issues - Other

Number of complaints: 247

Number of complaints satisfactorily resolved: 245*

*There were three complaints that the Inspectorate were unable to bring to a conclusion within the specified time period of the Annual Report. This has been due to the delicate and complex nature of these complaints and significant volumes of data requested during the investigation process.

O.k., they acknowledge at least 2 unsolved cases within the specified time period.
What does this mean exactly?

I make a claim that I'm the victim of say collusion and didn't get a rebate. I provide nearly irrefutable evidence. IOM commission says no you are wrong.

This is now labelled as a case resolved.

All of these gaming commissions are a joke that collect paychecks from the service provider. They work for them.... not us.

I understood satisfactorily resolved for the complainant, but they probably mean satisfactorily resolved for the operator.

This in a nutshell It doesn't say if the player actually got what he wanted. It should be broken down to explain if the operator was overruled and had to fork over money or reverse its decision... but that's not the case.

The real tragedy here is the IOM commission is viewed and is the best of the bunch.

Received the following explanation from the Isle of Man Gambling Supervision Commission:

Quote:
Hello Mr ...,

‘Satisfactorily resolved’ in this context means that the inspector investigating the issue was able to reach a conclusive decision on the matter; this could be in favour of the operator, the complainant or a compromise between parties.

The Isle of Man Gambling Supervision Commission confirmed all the 11 suggested bots from the Grand Leaderboard MEDIUM in this post:

http://forumserver.twoplustwo.com/sh...87&postcount=9

But confirmed only huij37 from the 11 suggested bots from the Grand Leaderboard LOW in this post:

http://forumserver.twoplustwo.com/sh...0&postcount=10

-> that is asolutely untenable! If Erichgonzales, treyshu, vinamorales, bkathryn, wengtung, gelportia, dedora, bekwa, huij37, ringjian, zubar and qiandrew are confirmed bots(and they are!), then marckun, yaling, yfen93, Gbarreto6690, jefjose, jiadao, grayishgray, starrpat, tommywu and mcado are as well bots.

-> they have all the same pattern of play volume during week 1 - 12 of the race

They also had superusers on their high stakes games.
I complained to IoM gambling and they did nothing to investigate this.

Licencing bodies just want their licence fee for the most part... but apparently SA was going too far with their house bots.

Dear Mr ...,

I write with respect to your allegation that software (“bot software”) was being used by players on the International Gaming Cooperation Limited (IGC) website, www.SuitedAce.com, in order to gain an unfair advantage during the “$300,000 Cash Race” promotion that ran between September 15th and December 7th 2014. The allegation has now been fully investigated, with my findings detailed below.

Having analysed the activity of player accounts involved in this promotion, the Isle of Man Gambling Supervision Commission (‘GSC’) concludes that a number of players did use bot software to gain them an unfair advantage during the “$300,000 Cash Race” promotion. The GSC notes that this is clearly in breach of the following SuitedAce website terms and conditions:

“2.4 Cheating and Unfair Practices

b) The following practices are strictly forbidden "Chip Dumping"; use of Player Assistance Software (including robots, bots, data mining and other artificial intelligence programs) and "player collusion".

c) For the avoidance of doubt, under no circumstances is any kind of Player Assistance Software permitted for use with Our Software or website.”

The player accounts that are in breach of these terms, I can confirm as having the following usernames Erichgonzales, treyshu, vinamorales, bkathryn, wengtung, gelportia, dedora, bekwa, huij37, ringjian, zubar and qiandrew.

For the purpose of clarity, when a player enters the tournament, they sign up to specific terms and conditions that relate directly to that tournament, however this does not exempt the player from the main website terms, as it states in the following tournament clause:

“3. Taking part in the Promotion represents acceptance of these Terms and Conditions as well as the Rules and the General Terms and Conditions as defined by SuitedAce which can be read here: www.suitedace.com ("the Site")”

In relation to the act of breaching these terms, SuitedAce’s website terms and conditions state the following:

“2.4 Cheating and Unfair Practices

a) IGC as a provider of gaming and wagering services is dependent on Us delivering a level playing field for all of Our customers. We are committed to using all reasonable measures to promote fair play and cheating of any kind is strictly forbidden when using IGC Services

d) If You are found to have used any form of software or practice to gain unfair advantage:

- Your IGC account will be immediately frozen and investigated;

- Your playing account will be frozen pending the outcome of Our investigation and all funds in your account may be subject to forfeiture

4.1 Without prejudice to any other rights, IGC may terminate this EULA if You fail to comply with the Terms and Conditions of this EULA. In such event, You must delete/destroy any copies of the Software in your possession.”

As a consequence of these breaches, the aforementioned player accounts were closed by IGC. However, they were not closed until after the tournament ended and winners publically announced on the SuitedAce website. Therefore, as it is the GSC’s role to ensure that the services offered by licence holders are fair, we determine that the activity displayed by the aforementioned players could reasonably have been detected and addressed by IGC at a much earlier time. Had this occurred, these accounts (in accordance with the SuitedAce terms and conditions) would have been at the very least been frozen, and as such excluded from the tournament.

Due to IGC failing to address this problem until a significant period after it occurred, the GSC recommends that IGC execute the action which it would have undertaken if it had identified the activity earlier, by retroactively removing the offending players from the tournament leader boards and adjusting the your position on the leader boards accordingly.

The GSC calculates that this would affect your leader board positions as such:

· Grand Leader Board (Medium Stakes):

- soleros moved from 3rd place to 1st place. 3rd place winnings are $5,000, 1st place winnings are $25,000

· Week 1 - 7 Leader Board: unaffected

· Week 8 Leader Board (Medium Stakes):

- soleros moved from 6th place to 3rd place. 6th place winnings are $200, 3rd place winnings are $1,200

· Week 9 Leader Board (Medium Stakes):

- Soleros moved from 6th place to 3rd place. 6th place winnings are $200, 3rd place winnings are $1,200

· Week 10 Leader Board (Medium Stakes):

- Soleros moved from 4th place to 3rd place. 4th place winnings are $800, 3rd place winnings are $1,200

· Week 11 Leader Board (Medium Stakes):

- Soleros moved from 13th place to 2nd place. 13th place winnings are $100, 2nd place winnings are $1,600

· Week 11 Leader Board (Low Stakes):

- Soleros moved from 16th place to 14th place. No change to winnings of $100.

· Week 12 Leader Board: unaffected

Following the above rationale, the difference in winnings would be $23,900.

Due to the fact that the you also lost and won amounts to those players that it has been established gained an unfair advantage (during individual poker games conducted as part of the tournament), the GSC recommends that IGC return you to a neutral position in relation to play against the above named offending players.

IGC have been informed of our conclusion, therefore can I please recommend contacting them for guidance in how they will now proceed.

Kind regards,

Gaming Inspector

I asked the Isle of Man Gambling Supervision(lol) Commission if International Gaming Corporation Limited is now obliged to give me their concluded $23,900 prizes not received + possible losses to their concluded bots or if this is only a recommendation and received the following response:

Quote:
Dear Mr ...,

We can only ever recommend that licenced operators pay funds out to players, we cannot force them to do so. Should an operator refuse to comply with our recommendation, they put themselves at risk of losing their IOM licence. As you are aware, IGC are no longer licenced by us, therefore if they refuse now, I am afraid that the only way to enforce the payment of your money would be by pursuing legal action. As I have stated previously, I am happy for you to use our recommendation in the course of legal proceedings, as long as it is quoted in the correct context.

Kind regards,

Gaming Inspector

Can someone please explain how they can ensure that

Funds Protected

On the Isle of Man we make sure that all licensee's have a system in place which fully protects all player funds. This means that any deposits or winnings you have with an island regulated gaming firm are secure and can be enforced by law.

Consumer Protection is important to the Commission. Players who gamble with operators licensed by the Isle of Man benefit from a number of protections. One of these is the way players’ money is protected. In order for an operator to obtain a licence in the Isle of Man, it must agree to protect players’ money. Players’ money is classed as deposits plus winnings plus any bonuses that have been earned. Players’ money must be protected by a mechanism approved by the Commission. Currently, three mechanisms are approved.

I consider leaderboard prizes as winnings and if they should not considered as winnings, then they are bonuses.

How are these announcements in accordance with "We can only ever recommend"?

If the sites don't abide by these conditions, they'll lose their IOM licenses, but you can take them to court while they have licences.

I think its time to realise that "regulators" don't care about anything other than stopping blatant money laundering. As an example I asked the UKGC under freedom of information how many instances of cheating at online poker had been reported to them (as licensees are required) since they took up regulation last December.

They answered ..... ONE! "which had been settled as not cheating after going to arbitration". (Stars alone must have had loads)

I queried this and they said they could only search for words that might match my question in their database as there wasn't a unique cheating report. So that means that despite cheating being a criminal offence and them having the power to prosecute, they simply ignore the reports and eg don't put them on a separate database for analysis.

The Isle of Man Gambling Supervision(lol) Commission even do not care about money laundering!

An Isle of Man Gaming Inspector expert concluded the following:

Quote:
To clarify, the ‘bot accounts’ were confirmed to be initially run by actual people, as was proved by their submission of identification documents and activity on the chat function. Additionally, their betting behaviour was not always consistent, suggesting that it was at certain times being dictated by a real person. The list of offending players had behaviour that indicated that some form of player assisted software was being used; however the accounts appear to have been created by real people.
Win prizes and or make money thru illegal poker bots is illegal money. Withdraw this illegal made money thru Neteller, Skrill or credit card is money laundering!

And even though the IOM GSC has the personal details of these criminals, they do not forward this info to the police.

This is protection of criminal poker bot user and the total opposite of what they state on their website, especially:

Quote:
Player Protection

As a body, it is statutorily charged to ensure that gambling is conducted honestly and fairly, remains free from criminal influence and exploitation and does not cause harm to the public interest, individuals and families.
The Isle of Man Gambling Supervision(lol) Commission is the most dangerous Commission I have experienced so far, as they do exactly the opposite of what they "ensure" and "make sure" and protect criminals instead of the honest customers.

This opens criminals door and gate when playing on a poker site licensed by the IOM GSC.

It is like someone tell you that he is your best friend and 5 seconds later you have a knife in your stomach. Very dangerous!

Feel free to ask the Gambling Commission why they do not report criminal poker bot user to the police, here:

I think you're getting carried away now.

No doubt you did some great work in highlighting issues, but calling the use of bot software as "illegal", and therefore claiming that funds obtained this way is "money laundering" is damaging to yourself (IMO).

That said, I will happily apologise and eat my own arms if you can show me where there is any written laws or legal precedent stating that use of bot software is illegal (rather than frowned upon, prohibited and/or banned at any site).

In every country where it is illegal by the criminal laws to play poker for money or on a site which has no license for that country, it is logically as well illegal to play poker thru poker bot software.

Legal precedent cases:

1) UNITED ARAB EMIRATES

http://www.pokerupdate.com/news/law-...playing-poker/

Three of the 16 were natives of the UAE, while the remaining 13 were citizens of a number of countries in Asia and Africa. Four of those charged - who were found to have uploaded software for the purposes of online gaming - were jailed for a year. The remaining 12 were jailed for three months each for gambling and playing poker (at least they noted the difference between poker and 'gambling').

An Islamic nation, the UAE has elements of sharia and secular law in its legal system. Due to this, all forms of gaming besides sports betting is illegal in the oil rich country.

2) SWEDEN

http://forumserver.twoplustwo.com/sh...48&postcount=1

Today seven people were charged here in Sweden with fraud, for running pokerbots at the swedish state gaming company "svenska spel"...

http://mobil.dn.se/ekonomi/storfuska...ka-spel/?brs=d

3) GERMANY

http://www.pokernews.com/news/2015/0...ling-20242.htm

Last week, the District Court of Munich published a decision declaring a man guilty of "illicit online gambling" breaching section 285 of Germany’s Criminal Code on an undisclosed online casino site...

Agreed. However this thread was started about a site licensed in the Isle of Man & the Regulations that apply there are being quoted by yourself. Can you please show me where it is written in law, or where there is legal precedence on the Isle of Man that allowing use of the software is illegal.

The fact none of the above relate to laws being broken in the jurisdiction where the site is/was licensed aside, at least 2 out of 3 of these are irrelevant & do not relate to the use of bot software.

The Swedish case however is interesting…

The news story is dated Feb 2013 & the thread linked was last updated in June 2014. It would have been good to know the conclusion(s). As it stands, thread post #10 reflects the point I'm trying to make.
“The key question is if it is a crime to run these bots, and if its a fraud. Thats not certain. They certainly broke the terms and conditions at svenska spel, but thats not the same as breaking the law."

This thread was started to collect experiences and proof of the huge number of poker bots which were running on SuitedAce and is successful(original title was: SuitedAce - bots experience and proof collection thread!).

The Isle of Man (along with England & Wales) is what is called a Common Law jurisdiction unlike most European countries. In practical terms this means that laws are not solely confined to Codes and Statutes. As such I am not able to give you specific details of what codes or statutes would apply for the use of poker bots.

I and my lawyer are not aware of any legal precedence on the Isle of Man in relation to the use of poker bots and as the Isle of Man Gambling Supervision(lol) Commission protect criminal operators and customers, it is very unlikely that such a legal precedence exist.
Maybe this will become the first legal precedence case on the Isle of Man?

SuitedAce state in their Terms of Service

"2.4 Cheating and Unfair Practices

- If We determine there are reasonable grounds, You will be reported to all relevant authorities, including the Financial Crime Unit if there is evidence of fraud or money laundering; and
- If We determine your playing account with IGC is to be terminated We fully reserve all other legal rights and causes of action We may have."

-> It sounds like poker bots are prohibited because of laws and not because it is frowned. Also, how could they report poker bot use to all relevant authorities, if it is not forbidden by law? I doubt all the relevant authorities will act based on frowned things.

How do you know the fact that laws of the IOM are not broken if someone laundered his illegal made money from International Gaming Corporation's Neteller account to his Neteller account?

I can inform you that money laundering is very well a breach of the laws of the IOM.

As the IOM GSC ensures that gambling is conducted honestly and fairly, remains free from criminal influence and exploitation, all three cases are relevant if someone played or used poker bot software in one of these jurisdictions.

User Freedom did the following:

- He deposited money illegal by the laws of the UAE from his Neteller account to SuitedAce's Neteller account.

This is also a breach of Neteller's and Skrill's terms and conditions, especially:

"11.2 It is strictly forbidden to make payments to or to receive payments from persons or entities offering illegal gambling services, including (but not limited to) illegal sports betting, casino games and poker games. We may suspend or terminate your Skrill Account at any time or refuse to execute or reverse a transaction if we believe that you directly or indirectly use or have used your Skrill Account for or in connection with illegal gambling transactions."

https://www.skrill.com/en/siteinform...nd-conditions/

- He played illegal by the laws of the UAE at SuitedAce, colluded together with user favoryt and won illegal minimum $30,000.

- He then withdrew this illegal made money to his Neteller account, which is money laundering!

What did the IOM GSC? Absolutely nothing!
