To start off sorry if this is the wrong place for this. But here is my situation...

Yesterday I recently went up to harrahs and won a $50 poker tournament, by winning I received cash as well as a $200 dollar satellite seat for a tournament where the winner would receive a seat in the WSOP main event.

now my question is I am most likely about to be put on probation for my second Dui (on a good note I have stopped drinking...havent had a sip for about 5 months) that happened last september. I have court in Feb.

will I be allowed to go to the Casino when I am on probation, The satellite is in march.

and should I win this would I be able to go to vegas to play in the main event

My court date is not until Feb. so I am not on probation yet and dont have a PO right now. Although I assume i will be placed on probation. I guess I am just wondering, if anyone else has seen a situation like this or that has been on probation for a Dui and wanted to go to the casino or travel... just so I might be able to know what to expect, seeing as how that would suck if I am unable to play in this tournament i doubt i can refund the ticket for $200

Not much sympathy for drunk drivers here I'm afraid - would have sucked worse if you had killed someone driving drunk. If you're not able to play, well - consider it part of your punishment and hopefully lesson learned.

Glad to hear you're on five months sober; keep at it and focus on making better choices both at and away from the table. They'll be future chances. Good luck.

Is the casino in your home state? Probation can result in limits on your ability to go out of state (YMMV). But you can ask your PO about it when you get one.

I imagine this would be a question you would want to ask when you go to court as the rules likely vary from state to state and as such what applies to you may not apply to others who may respond.

There may be a probation office in your jurisdiction that should be able to help.

I'd imagine since it's not illegal activity it should be ok, but it's one of those 'fringe' activities where logic doesn't always apply.

I don't think you will get a straight answer here, sorry!

forgive my ignorance, If you are on Probation, you are not allowed to play in a casino?

It's not illegal to play in a casino so how could you possibly be restricted from doing something legal? Don't you have an attorney? Ask your attorney.

I have never seen terms of probation contain a general restriction preventing a person from going to a casino. You can expect terms that restrict your ability to travel .... so that may impact things. And in as much as your offense is alcohol related youshould expect to see a term restricting you from drinking. You will likely be prevented from driving. It is possible that you will be restricted from being somewhere that serves alcohol (I did not generally see such broad restrictions but it is not out of the question). If in any way your offenses were related to casinos then I might expect to see a term preventing you from go to casinos, but probably not for DUI (though if you were driving home from the casino drunk .......)

But as someone else said ... ask your attorney.

Get off your freaking high horse already. Believe it or not, it's possible to be negligent and kill somebody without being drunk. It's also possible to be legally drunk (BAL over 0.08) yet have little noticable impact on faculties.

The guy (allegedly) broke the law and is almost certainly paying the price for getting caught. He's not trying to justify it, he just wants to try to live his life while dealing with the consequenses. Leave the judging to the judges.

Op, it's been quite a while since I've been "on paper" (I'm an unabashed pothead myself), but I don't remember there being a whole lot of restrictions on places you could go. Certainly there are travel restrictions, like for me I couldn't go outside a 3-county area where I live. I'd imagine a big part of this is if it's felony probation or misdemeanor, as I know felony probation is much more restrictive.

You will likely be placed on informal probation, meaning if you get arrested anywhere near alcohol or under the influence of alcohol you will be in violation. Besides that probably won't be a problem, I've been to Vegas and back many times on informal.

The judge will issue an order, and probation will inform and enforce, any stipulations regarding post-conviction probation compliance. As a rule, these things are all worked out in advance with the prosecutor, your attorney, and the court. You don't want to be dickering about travel restrictions in open court in front of a judge. He/she will go ballistic, tell the attorneys to settle it all out, and come back when they are ready.
You must convey to your attorney the concerns you have spelled out here in this forum, and be as forthright and truthful as you have been here.

I've been where you are at right now, 17 years ago.

2X offender, lost DL for quite a while, been sober by the grace of God ever since, and my life is good and manageable again. And yeah, I had plenty of pricks like the dickheads you've encountered on here giving you their $0.02 about how they feel about your problem, and what you need to do about it. As if you didn't know it. You ask a poker-related question, and get piled on about drunk driving and how you could have killed someone, and insurance is high because of you, and you a bad person, and you suck, and I'm superior to you because I never got caught driving drunk......I say F U to all of them as well. but anyways.

My attorney was also a sober alcoholic like me, and got me thru it. PLEASE tell him/her all your concerns, so you know in advance if you are restricted in any way. You are going to have to agree to all of it. In general, you will have restrictions on out-of-state travel in many states. If this is known in advance, something may possibly be worked out. I never had to go out of state, except briefly on business, and my PO always knew it.
It gets easier, but it can also get harder, staying sober. We tend to be our own worst enemies simply because we don't know how to live a life completely free of alcohol. You know how to stay clean for five months, and thats fantastic. You are going to learn how to do it for six months, starting today. Imagine playing PLO/8 for the first time, and not knowing all the rules. You think you've got a good handle on it, but it does take some time to learn. Just like learning to live w/out booze. My one suggestion is to put all the negative people like - "consider it part of your punishment and hopefully lesson learned."- Dragon Ash - out of your life.

The answer, like always, is "it depends."

Probation rules will vary by state/county and the specifics of your offense.

You should talk to a local attorney.

You'll probably be able to travel out of state assuming your record is otherwise clean, but you will have to notify your PO in advance. I think you can also go into the casino while on probation, but this might vary by state and gaming regulations. And both could be influenced by other specifics such as if were you DUI from a casino or had any legal "issues" in or near a casino.

You should probably see a certified alcohol/substance abuse counselor and get an official written evaluation before your court date. It will look good as far as everything is concerned to show concrete evidence that you've changed since the offense. Again, consult a local attorney and they tell you if this is potentially useful and where to go.

laws vary state-by-state but if you're not allowed to leave the state for a certain time that will be made clear to you.

you definitely can't enter Canada tho. that I'm sure of.

an it's not like they're tracking your movements or anything, it's just if you get pinched they'll look you up and you'll be in a little extra trouble.

You will more than likely get a ton of conflicting information and misinformation here on legal issues. Just wait until your are sentenced and work it out with your lawyer and PO after the court proceedings are over.

It definitely depends on what type of probation, your state and county. It sounds like your biggest issue will be travel restrictions which no one here will be able to accurately answer, unfortunately.

If I had to bet on it though, I'd wager you'll be able to go to casinos and Vegas without an issue; but you will soon see. Good luck OP.
