In live play it is not a misdeal, in tournament play it is.

if he isnt a blind, no harm done no matter what he does. if he didnt announce his buyin it is automatically the minimum for that hand.

if he folds without looking and its his blind a misdeal. if he looks and its his blind he needs to put it up but who can force it or want to waste the time.
