"All 5 are part of the draw.

The players should be able to sit out for the entire time the house rules allow for a dinner break. Their rights at the table don't change based on the reason they are taking a break. Doesn't matter if it's because they are hungry or just want to sit out of current game dynamics. The house rule on breaks applies. You can say they are refusing to play, but it's just a break."

That sounds like an angle. Those who "threaten" or "pretend" to go on a dinner break should go on a the break and the 3 willing players continue to play 3 handed. I see no problem with this. The 3 willing players must be allowed to continue playing regardless of anything else imo so there is no draw (edit: at all because there is no break).

Heard a floor at the Borgata tell some late night players that he would never break a table... but if they players wanted to break, he would find them available seats.

I wonder if the 2 players who didn't want to play short would have been placed in the open seats and the 3 players who agreed to play short would be left playing short?

I'm guilty of taking about an hour away from the table to have a cigar. I'm more likely to do that in rooms (AC) that already have walkers who go for dinner breaks, or guys that go to the racebook, slots or pits. In the PA rooms, there seem to be less walkers and I seem to be more likely to save my cigar break until after the session.

I've never been picked up, but have come back to 2 absent buttons (2 new dealers since I've been away). I think the 3rd one + a wait list = floor called, at least at the Borgata.

of course they would. Who would complain? The floor was happy to leave the table going. The two who wanted fuller games would be happy and the three who wanted to play shorthanded would be happy.

Or are you saying the 3 wanted to play 5 handed but not 3 handed?

Are you saying you only walk when other people are walking, or just that you only walk in rooms where many tend to walk?

3 players would have played 5 handed, unknown if they would have played 3 handed. Even if they were willing to play, it may be that they still would have preferred more players and not actually 'wanted' to play short.

I tend to walk in room that have walkers, and I try to walk after they have returned (and are likely to remain at the table).

Can't speak for the Borgata but in my room 5 players is considered short and players aren't required to play short so if the 3 remaining wanted to play three handed they would generally be allowed (barring some circumstance such as dealers on OT that made the floor want to break the table) and if they didn't want to play three handed they break the table.
