The hand held and position relative to the button don't play a factor in mtt finishing position. If both players had the exact same starting stack size, that would be the only true case of a tie.

They should work on a policy for this. Really what they need to do is hire a consultant who's well versed in poker as a number of these little growing pain issues could have been avoided.
As for crashes, while they don't have a policy in print yet on how they will handle it, they already faced the issue on the first day of the PLO tournaments (they crashed at the end of the rebuy period) and they took care of the players affected fairly with a policy of we're going to make it right plus a little extra. If they continue to deal with issues in this manner no one is going to complain about that.
