So to clarify - there are tons of old threads that would no longer be allowed. and for the purposes of the rules are considered as closed or not existing.

They will be reevaluated if they are resurrected.

What happens when someone wants to make a non content thread but they forget to do the !!! thing? Surely this has happened and the forum is littered with non content threads that aren't marked as such, and are incorrectly moderated as a result.

Content isn't banned from !!!threads. It just means that you can make it about posters, troll, personal attack etc etc with minimal constraints.

chezlaw's biggest problem is all the ridiculous minutia of rules and regulations, and how arbitrary, vague, and heavy handed he is.

He needs to just lighten up and let people post FFS. Oh dear, the topic of a thread changed? OMG end of the world, call the slayer. Oh gosh, people are bickering or posting music or bull****ting about nonsense? Wrong, sad, low energy, kill it with fire.

If people don't find the environment of a forum welcoming, they're not going to make much effort to post, and the content is going to be ****ty. Cheztapo makes the forum unwelcoming.
