I was thinking of cashing out but I want to avoid all legal altercations.

Section 849.14: Whoever stakes, bets or wagers any money or other thing of value upon the result of any trial or contest of skill, speed or power or endurance of human or beast, or whoever receives in any manner whatsoever any money or other thing of value staked, bet or wagered, or offered for the purpose of being staked, bet or wagered, by or for any other person upon any such result, or whoever knowingly becomes the custodian or depositary of any money or other thing of value so staked, bet, or wagered upon any such result, or whoever aids, or assists, or abets in any manner in any of such acts all of which are hereby forbidden, shall be guilty of a misdemeanor of the second degree.


That seems bad. Has anyone tried?

Nobody has given me a straight answer yet. That is why I started this thread. I keep getting referred to different threads with people saying their opinions.

I started this one to see if any Floridians have had any success withdrawing already. The other ones were to ask if it was legal or not and I have found out that it is illegal as depicted by my original post in this thread.

Start the thread in the poker legislation section of 2+2, you'll get proper help there

Op finally posted in the right place after posting in nvg and internet poker section wtg op hope people have quelled your fears of arrest. No one to my knowledge has ever been arrested for cashing out poker funds and I doubt you will be the first.

@ZeckoRiver I think he still posted in the wrong forum, but at least he got his info. Is the Poker Legislation a better place for the post?

@blakeatron I also also don't know of anyone who has been convicted for playing online poker or cashing out of an online poker room.

Dude stop being naive, NO one has gotten arrested for playing or cashing out funds from online poker. NO ONE!!!!

Stop worrying, you CANT get arrested if anything its the sites fault for letting you play.

Im not being naive. That's like saying "its the stores fault for letting you steal". The laws clearly state you can receive a second degree misdemeanor for playing or receiving funds. I just wanted to know if this has happened to anybody. Chill out.

The statute of limitations on filing a misdemeanor is 18 months most places. So, only gotta sweat it out for 18 months after cashing out. Never know when the knock on the door is going to be the process server summoning you to court. Scary, scary stuff. I assume there's another statute listing all the exceptions in Florida for jai alai, greyhound races, slot machines at the greyhound track, poker games at the greyhound track, horse races, poker games at the Hard Rock, etc, etc. Such hypocrisy.

Thats 2 different things dude.

The poker sites say "YOU CAN PLAY" so its the site fault for letting you open an account and play. Because the site lets you play, they are basically agreeing that you are not doing any form of illegal gambling.

The store on the other hand says, "YOU CANT STEAL" so therefore if you steal you go to jail.

It doesn't matter what the site says it.matters what the laws say. If you ask the live assistants for the websites they say "I can not say whether it is legal or not you'll have to refer to your particular state laws. In general, WE BELIEVE that it is ok for you to play". It's their opinion. Laws> opinion

This is entirely wrong. If the site says you can hit another customer, it doesn't just mean the customer can't sue you for assault or a similar law.

Your post is entirely incorrect. If there really is a law in Florida that says playing online poker while in the state is illegal, then there is some cause for concern for players.

If you want to find out detailed information about that, the Poker Legislation forum is the place to go.

I personally haven't heard of that law, but I did hear Florida passed a law that might impact online poker recently, so start in that thread in the PL forum.
