I’m selling action for the WSOP 2011. I had previously sold all my action (see http://forumserver.twoplustwo.com/18...-20-a-1007244/) but the deal fell through because of tax issues.

Note - I am from Australia which is a non US Tax Treaty country. We are charged 30% withholding tax at the cage on net winnings in excess of around $5000. I have researched the issue extensively and I consider it highly likely that if the backer is from a US Tax Treaty country, I can recover your % of the tax by filing a tax return with the IRS and providing relevant documentation detailing the staking arrangement. Pay out of winnings would initially be post-withholding tax, but I will provide whatever full refund for that tax that can be achieved when I file a tax return with the IRS.


Background

My name is Josh Budin, I'm 29 years old, live in Melbourne, Australia, and have been playing poker (both online and live) since the start of 2006 (under the screen name oasis00 on FTP; 00oasis00 on Ongame; and similar variants on a number of other sites).

I have made approximately $500,000 from poker since I started. I played online cash games in 2006 and 2007 on the Ongame network, working my way up to 3-6 and 5-10 NLHE. From about mid 2007 I began playing MTTs and Heads Up Sngs, and have been exclusively playing MTTs and HU SNGs for the last 3.5 years. I quit my job as an intellectual property lawyer in June 2009 and began playing poker full time, predominantly as a HU SNG specialist (mainly on Full Tilt), but also playing about 40 MTTs a week (mainly on Ongame and Full Tilt but also playing the majors across the main sites on Sundays).

I have an ROI of 72% for Ongame MTTs (including 1st in the 100r $100k guarantee for $24k in December 2010).

I am selling action at 1.20:1 for 50% of the preliminary events (as a package) and 60% for the main event.

10% shares of the 7 preliminary events package cost $780 (13,000*0.5*1.2/10).

10% shares of the main event cost $720 (10,000*0.6*1.2/10).

10% shares of total package is $1500. Would obviously prefer people to buy in bulk if possible for ease of administration.

Funds can be transferred online or given as cash in Vegas.

I will be in vegas from 7 June. Online transfer or cash in vegas is easiest, but if your only option is bank transfer I can do that (just more fees and double exchange rate commission as it will be transferred into AUD and then i have to w/d it into USD in vegas)

What country are you from AEK? I've consulted more people and I might not be able to get US Tax Treaty country's portion of the withholding tax back

Are you saying if I'm from a country which has a tax treaty with US (I'm from UK which does). You won't be able to claim back the tax you'll have to pay.

If this is the case then obv won't be able to invest.

Everyone I talk to has a different opinion and it looks uncertain, so I don't want to make 100% guarantees or mislead you. If that's a deciding factor than you should not invest, because obviously it's out of my control what the IRS will do when I file a tax return.
