Prisoner's dilemma. If the market is left to determine 2 and 3 regular players are going to act in their best short-term interests and play at the sites that allow them to do those things. These sites will get more players (and have more games running from people mass multitabling). The increased traffic makes them more likely to win out.
So if the market is left to determine the outcome these sites are quite likely to be the ones that win out because everyone (including fish) wants to play at the biggest sites.
But the rate the fish will lose at is going to discourage them from continuing to play. Which isn't in our best long-term interests.
An artificial limitation on those two factors may force us to behave in a way that is a better long-run outcome than an unregulated environment.
