Re: Ky Supremes rule yet ?

The KY Supreme Court is definitely scheduled to release opinions today. There is no guarantee, however, that the domain-name case will be among those opinions.

We will know by the end of the day.

If I understand the process in KY, the Supreme Court releases opinions in regular batches every month or so.

According to one press source:

"The Kentucky Supreme Court will issue its next set of written decisions on Jan. 21, and the case is likely to be included. If, for some reason, the decision is not made by then, the next date for the court to release decisions won't be until March."

Looks like the domain-name case wasn't included in today's KY Supreme Court rulings. Maybe next month.

Is this good or bad? Does this taking of more time mean that the case is very close?

Doesn't really mean anything for certain, Lostit.

The possible reasons are legion, and this information is about as useful in guessing a result as trying figure the probable hole cards of a limper who has limped the past 10 hands in a row.

That would be nice, coming one day after our "Irish National Holiday".

Re: Ky Supremes rule yet ?

Kentucky Supreme Court Decision

Quote:
This case arises from an order by the Franklin Circuit Court that 141 internet domain names be seized from their owners and operators and transferred to the dominion and control of the Commonwealth . Attorneys acting on behalf of the domain names sought a writ of prohibition against the seizure, which the Kentucky Court of Appeals granted. Because the parties seeking the writ have failed, to demonstrate that they have standing to do so, this Court reverses, though this does not foreclose the possibility of future relief.

Quote:
Conclusion

Due to the incapacity of domain names to contest their own seizure and the inability of iMEGA and IGC to litigate on behalf of anonymous registrants, the Court of Appeals is reversed and its writ is vacated . This case is hereby remanded to the Court of Appeals with instructions to dismiss the Appellee's writ petition .
