I have no idea why they didn't get a charge for the weed. Could likely be to the fact it wasn't in plain view or something. However, if the "stuff" he shouldn't have had was a class A narcotic and he was sitting in Clark County (which of course he was), he's going to go away for a very long time unless he's got some serious cash behind him.

Yeah def dumb on both parts. It wasn't H. He has decent amounts of cash and he actually does have one of the best defense attorneys in Vegas. I'll try and find out if he talked to his lawyer today. His arraignment isnt till June I think.

Nothing was in plain view at any time.

Not a guarantee that he is gonna go away for a very long time. First time he has been busted and he has no record so that might help him.

He had a LOT more then 1 oz. He does not have any priors though.

I'm no lawyer, but seems to me that OP stands a fair chance of being called to the stand if his friend ever goes to trial for a felony drug trafficking charge.

Anyhow, I had no idea it was legal for hotel staff to detain people at will or to search their property. That's pretty screwed up. Do the hotels have absolute discretion in this regard? I thought all they could do was to call the cops.

And if it turns out the hotel overstepped their bounds thus causing the guy to face criminal charges, I wonder if OP's friend could file a civil suit against the to recover legal expenses plus intangible damages.

I hear ya, I didn't even charge him for the room, he's a good friend of mine, apparently he's just really stupid even though I blame the sloot that was with him for calling the bellman.

First offenders don't usually go to trial here, usually its resolved with a plea bargain. When I find out i'll let eveybody know. Don't think he will be eager to sue a huge company like LVSands once it's resolved.

there are laws that allow private establishments to detain people they suspect of committing some sort of crime... the same laws allow stores to detain shoplifters. theyre actually posted at a lot of casino cashier windows (i guess to discourage fraud?)

As for civil liability, its unlikely unless hes somehow acquitted in his criminal case. Imagine the precedent it would set if someone could be held civilly liable for aiding in the arrest and conviction of a criminal.

Hey King - After reading the first post, I found myself chuckling as I envisioned how the story might have played out. This is what popped into my mind.

Truth be told, it's probably not any sillier than the real story. Only your friend would have been in a position to know for sure, and he probably can't remember. Too bad they can't watch themselves on film the next day.
