i was always under the impression that the owner of private property can legally enter the room if there is suspicion of crime (this includes opening their drawers/dressers) however they cannot legally search your personal belongings (backpacks, suitcases etc). The most they can do is notify the police and have them search your items (assuming probable cause, as in this case).

so the lesson should be: store your **** in your suitcase not the desk drawer.

In Young, hotel security entered the room and found a gun and then called the cops. The 9th Circuit reversed the trial court based on the above holding.
Bobby, for all your preaching and lecturing about reading comprehension and understanding the law, it's pretty LOL that you failed to recognize that the parties in Young conceded that for the second search (the one that mattered), the security guards were acting as government agents.

That part surprises me, I would have thought you'd be persona non grata with them over this, if for no reason other than that you weren't staying in the room. I guess they don't really care about who actually uses the free room as long as they're getting their action. That's instructive knowledge for the future.

So a guy got busted for smoking weed on private property... Sounds like he got what was coming to him. I don't mean to sound like a jerk, but if he wouldn't have broken the law in the first place, none of this would have happened.

Personally, I'd get an attorney on retainer too just in case if it was in your name. There might be some goofy law that you're responsible for a rented room under your name.

However, I have no sympathy for anyone who does illegal drugs and is caught. Just the way I am. Sorry.

I think you're missing the point.

Say I rent a car. I then lend it to you. You smash it. I am responsible for the damages as it was rented to me and not to you.

Same applies here. You rented the room. As far as I know, you're responsible for what goes on inside it.

banzi, I meant the original thread. There was more to it than just the smoking. They really trashed the room/ took down the smoke detectors or something.

Correct, under The Clark County Code you are presumed guilty if any contraband is found in a hotel room rented in your name, no further questions asked. This also applies to contraband found in a future tenants' room if you at one time rented that same room.....

Can you please provide a link to that law please? He got arrested and charged. He's out now. I was down at the Palazzo the day after he got out. Spoke to the front desk, they gave me the deposit back and even credited my comp account back. He is the only one that got charged and 86'd from the property. The girl with him didn't even get charged, she was let go. They found the stuff that he was charged with in his bags not mine, I didn't have any bags in the room, I wasn't even in the room except for 5 mins a little while after he was checked in. I checked him in at around 4pm, he got in trouble around 3am. I don't see how they would charge me with something. Would the charges be checking my friend in to a room illegally? They have plenty of cameras in the Palazzo, they would be able to tell if I was there and had anything to do with it.

There were no physical damages to the room, I understand your point if say he broke a lamp, then I would be responsible. He didnt break anything except the law, which is why he was charged and not me. Theres a big difference between the two.
